It's a shame you feel tlike this although i can completely understand where you are coming from. The HTC Legend has been something of a problem handset for HTC, it is the exception rather than the rule and I think HTC will have learnt from this. I've had 3 HTC made handsets and never an issue.
There are some fantastic HTC handsets on the way, The new One series handset are looking very promising and got some very good reviews when the were announced.
Nokia had the same issue a while back with the N97 series of handsets. Massive range of issues which they eventually managed to get sorted through a series of software updates but I think that was one of the final nails in the coffin for Nokia made software.
I think the Tech Team need to get involved with this case.
Under UK consumer Law a company has to be given a reasonable chance to repair or rectify a faulty device. This is widely accepted as one repair attempt. After this you are entitled to a replacement of similar or greater specification if that model is no longer available.
As this model is still available this is why you are being offered the same phone.
I am in no way stating that you are entitled to a different model, just that you have demonstrated six reasonable attempts to rectify a faulty device.
