Let me get this right, GIngerbread was released six weeks ago but unless I root my Nexus One and invalidate my warranty with Vodafone, I won't get Gingerbread until Vodafone have finished messing around with their stupid 360 app that no-one actually uses????
I chose this phone after being messed around with getting a Desire and one of the things that sold me on the Nexus was the availability of instant updates from Google.
Yeah, right!
I have tried asking on Twitter when the update will be available but get fobbed off with stock answers. The same stock answers come from the occasional appearances of Vodafone staff on here. And when I went into my local shop, I was ignored for fifteen minutes before walking out....
DEFINITELY Carphone Warehouse next time!

Hi all
As much as I can understand your feelings around this subject, I do not have anything further to add at this moment in time.![]()
As soon as any further information is released concerning this, I will inform you as a matter of course. All I can do at the moment is point you to the Firmware FAQ's.
Regards
Trev

Does this fall under misrepresentation of goods/services?

Find the CEO email address online and complain. I did when Vodafone stopped releasing FW updates for my white N97 (although did so for the black one) and I got a new phone out of it. Didn't want to complain but seeing as the updates fixed a lot of issues I kinda had to.
Not saying Gingerbread 'fixes' a lot of issues as rooting does that anyway but I'd imagine if it's Vodafone dragging their heels with the update (which must work fine as otherwise those with SIM free handsets would have issues) then they should either release the update or allow customers to have a new phone

I sent an email off yesterday but got a standard 'see the firmware statement' reply this afternoon
I have replied asking for more info, ill report back on that one. lol
EddyOS,
Had the same with my Dad's N97 but i think the only reason they gave in was because Nokia had pretty much given up on it. One week later my dad had a new HTC Desire.

Just wanted to say how I couldn't agree more. We were sold the Nexus One on the premise of Google updates and I do not believe that we will ever see Gingerbread released by Vodafone for the Nexus One. If they are still testing it how come thay are promoting it on the newer models? It stinks and it is a simple case of abandoning the old Nexus One for the new Nexus S. I would love to manually update, and the instructions kindly posted on these forums are very clearly laid out. However, if I received the slightest different message or error, I would have no idea what to do. On the "Gingerbread OTA" topic of the forum, I have asked if anyone would be able to do the update on my phone for me which I know is rather sad and am frustrated with myself for not attempting to update. I am so disillusioned with Vodafone over this, I have written to several different departments telling them that it is impossible to buy an Android phone from them in the future and urging them to get a senior manager to read the forums to see how many people are hacking their phones and will not be buying from Vodafone again. Everytime gets adifferent response or a stock answer. The only satisfaction is that, with Android becoming the number 1 system, and Vodafone not being geared up for Android, they will inevitably lose customers which may eventually bring a change. I do however feel determined that my "updatable" phone should be updated to the latest version before my contract runs out (I am just under one year into a two year contract and so have been abandoned less than halfway by Vodafone). I do not understand the secrecy. To me it is clear that there will be no update and I cannot believe that Vodafone senior staff have not learned (or do not care) from the release of Froyo 2.2 and the unhappy postings on the forum on that occasion. It is a shame that it will take leaving Vodafone to get satisfaction. Again, i just wanted to say how much I agree with you. PS. The Nexus One IS a brilliant phone. I just regret buying it from Vodafone.

I'm sorry Trev, but I cannot accept that!!!
Someone in Vodafone, somewhere must know what is happening with regard to Gingerbread and the Nexus One. If you do not know personally then there is bound to be a phone number that you can call, a department that you can contact or a person that you can talk to.
It is getting ridiculous that Nexus One users cannot be given some sort of update on this!

Ok,
Sent some emails yesterday, firstly from Vodafone....
"
Hello Simon,
Thank you for contacting Vodafone Customer Services.
Simon, I would like to inform that upgrades in the software or operating systems are not done through Vodafone.
I request to please contact the Handset manufacturer."
and then from HTC...
"Thank you for contacting HTC regarding the HTC phone.
We are very happy to hear of your interest in our products, its really appreciated. Gingerbread has not yet been released.
We cannot disclose when any new products/updates will be released or if they are even in development, however keep an eye out for our official announcements on www.htc.com. This is where you can find out the latest info on HTC."
Interesting!!

Now I'm wondering if Gingerbread even exists....
Interesting blog here
Seriously, can we get an online petition or some form of letter from all of us discontented customers to send to a real person who is supposedly in charge?!

I have just seen an advert for the Nexus S which was described as "Free Range Android" and "Pure Google". If you selected the "Buy Now" option you got a choice between buying from Carphone Warehouse and buying from Vodafone. You can see where I am going with this, but this is exactly the trap Nexus One purchasers fell for. The ads are just not true and they are doing it again. You cannot get true Android from Vodafone. This is why there are so many frustrated people. It is not just disappointment at having an older handset, it is the unsatisfied expectations and unfulfilled promises that will make people buy elsewhere next time.

As Samsung is Google's new best friend it's expected that they get it first - just as the Desire got it before other handsets once 2.2 was released

Thanks for all responses - good to know it's not just us!
Have just seen that the Gingerbread update for the Galaxy S was suspended by Google the day after it was released..... I haven't seen if it's available now or not.
Also, on another thread called My Nexus One, Wiill it upgrade to Gingerbread was this interesting comment from mckeowngoo:
This got me thinking; why don't I call Vodafone back and speak to someone who might actually be able to tell me when the Google Nexus One is going to get Gingerbread OTA from Vodafone.
As I have said before, I don't want to unlock the bootloader, invalidate the warranty and have to possibly pay for a repair to my phone in the future. Having not being able to find the passing image file that went the rounds and was pulled from the servers, I wanted and still want a properly supported with warranty phone.
So, many phonecalls later, being bounced around from customers services, to billing, to phone insurance department, some nice lady who said I should look on the HTC forum (!), a lady who said there was no update due for this phone and finally to a nice lady in the technical issues department who contacted someone higher up in the tech help department, I was told that.........................
The Google Nexus One will receive the Gingerbead 2.3.3 update OTA at the end of April / start of May 2011.
And there you have it. I will hold Vodafone to this and if I don't get the update, nearly three months after everyone else with a non Vodafone N1, the VF can go into a room and make sweet, sweet love to itself as I for one will not be getting another mobile phone from them.
I'd be happy with next week, if it actually happens! Fingers crossed
