Default on credit file

Hi,

I need to speak with someone from the credit file amendments as i have given up with customer relations!

Basically, my wife decided to go online and open an sim only deal in my name (she has messed up and is willing to accept what she has done) she though it was a monthly rolling contract, still doesnt make it right! but obvioulsy i dont want to get my wife done for fraud over a mistake she is willing to pay.

 

Anyway, i have phoned and argued with the relations team and they acknowledged to me that they believe the account was opened in my name without my permission etc.. even have this call recorded i also have audio of Ziad from Vodafoner saying if my wife pays the outstanding balance then they will remove my account from my credit report

 

My wife even told Vodafone she opended the account without my permission and my wife offered to pay the money owed to them and they said they would accpet the payment, but default stays with me.

 

I have been in touch with the communication branch of the financial ombudsman and been advised to email and this to vodafone but i don't know who to contact?

Your wife must have had account access to open up the contract which would include passwords and maybe even named on your account.

As your the account holder your are responsible for who you allow access and if then a default happens then it's your Credit File that is defaulted upon.

A person has a 14 day cooling off period to be able to check whats been opened and check the terms.

Vodafone usually send a confirmation email to show what's been agreed upon.

However that said fo speak with the Vodafone Social Media Teams about this.

As the Vodafone Credit File Specialist Teams are not customer facing you would need to contact the Vodafone Social Media Teams via Contact-us-for-account-specific-queries  and they'll collate your information and get their Credit File Specialist Teams involved @DLedbury666

This is a tricky situation. 

 

Legally Vodafone have a responsibility to make other Lenders/Credit Providers etc aware of financial risk.

 

If the A/c was opened without your knowledge, the only way to get it removed completely is to open up a Fraud Case with Vodafone or ActionFraud. I appreciate you are unwilling to do that, and Vodafone may reject the Fraud case anyway, viewing it as a third-party dispute between family members.

 

The only other alternative is to have the bill paid in full. If this is done, Vodafone will remove the default notice from your Credit File, but legally they will have to leave a Late Payment marker on your file. While this will affect your Credit Score, it is nowhere near as bad as a Default Marker. 

 

You don't mention how long ago the default occurred - these things usually remain on your File for no more than 6 years from the default date.

I really don't want to open a fraud case against my wife obviously. She is distraught about it and she genuinley thought it was a monthly rolling sim deal.

 

I have made call after call to Vodafone and as stated in my first post, that my wife was/is willing to speake to Vodadfone to admit her mistake and PAY the final sum of money and they remove the default from my report.

 

I am getting nowhere on the phone with them and have been told if she pays then they will remove the default then someone else says pay and default remains. I have recorded calls with them saying they will remove default if my wife clears balance. Then someone calls with final resolution saying default stays.

 

So stressfull!

@DLedbury666 I appreciate how stressful this must be for you, especially when getting different information from different advisers.

I've spoken with our Credit File team directly and they've confirmed they'd need proof that the account wasn't taken out by yourself in order to remove the default. This would involve getting a police crime number and it being confirmed that it was third party fraud. 

I understand that this isn't something you'd like to do with it being your wife that used your details. Without the proof required, the default would remain on your credit file and the team would be unable to assist further.

I would to have serious think if that is my only option, not an easy one to make that is a bad hand :Sad_face:

 

How would i know for sure, if i did get a crime reference number and jump through hoops that this will get removed from my file? because so far i have been lied to from collections (more than once) on the phone and would only consider reporting this if the account is removed from my report?
