Buying unwanted iPhone 6s plus upgrade

I've bought an unwanted upgrade 6s plus from a Vodafone customer. It's locked to Vodafone which he says he has requested the code to get it unlocked. Once this is done is this phone completely mine? Can I use my giffgaff sim in it straight away? If he decides to stop paying his contract will this affect me in any way? Please HELP!!!

Also I would imagine that its highly unlikely VF will unlock the phone so quickly

says "Does the phone need to have been used on Vodafone UK?

Yes, even if you've bought your phone secondhand.

 

For Pay as you go, you'll need to have been using your PAYG SIM in the phone for 30 days.

 

For Pay monthly you'll need to have paid three bills on time"

 

How are you as a person who has purchased a phone second hand able to ascertain the status of a second hand phone. (Apart from knowing when the iPhone was launched) if this T&C wasn't highlighted you would know and I'm sure many contract customers are unaware.

I'd be very dubious about it.. 

just throwing this out there so dont take this the wrong way..

I wouldn't be suprised if the seller received an additional phone in error by VF due to all the pre order and new order issues..same happened to us..we received an extra handset that VF state was never sent out.. I dont want it biting me in the ##~## in 6 months time and selling it on and it becoming blocked..or charged for it.. so I have contacted VF to send it back!

By exercising due dilligence and asking for proof of ownership.

 

Would you buy a second hand car from a private seller without checking that there was no finance outstanding on it?

 

Also the fact that it was advertised on Guntree which is a haven for scammers should be a good reason for double checking.

I doubt that would make any difference. The phone was not the sellers property to sell in the first place.

 

I would have thought that would have been a good enough reason to go back the seller and ask for a refund.
