That's a bit bad - I've heard very good reports of them and I think it would be worth trying again.
IMHO, the shop was wrong to suggest that you'd get a replacement phone. The first line of attack would always be a repair and you'd only get a replacement if that wasn't possible. Vodafone don't stock HTC devices now, so getting either a replacement or an upgrade to a 10 wouldn't be possible and you'd get the nearest equivalent.
Have another go at HTC. If you can make contact, get your phone back from Vodafone and send it to them. If you can't, take the line of least resistance and accept the best they offer. Whether you leave is up to you, but no network is going to be able to supply what they haven't got. (It's sometimes best to buy SIM-free to give yourself maximum flexibility in that regard).
