IPhone 6 battery

My iPhone battery went from being absolutely fine, two weeks ago, to claiming to be out of charge with over 90% remaining.



I went into the store, who informed me that this was a battery issue and that I would need to pay to have it replaced as it is out of warranty. I explained that this was not acceptable as, under the terms of the Sale Of Goods Act (which applies here, as the device was purchased prior to the 1st of October 2015) I was entitled to expect the battery to not fail as completely as it has after just over a year. Batteries typically degrade in performance, not fail completely. In short, I have a reasonable expectation for this not to have happened, thus I am protected under the act.



The store were not interested in my argument. I took this up online, on 04/11/2015, and after much discussion was phoned by a Vodafone representative who promised me that if I paid for the repair at the Apple store then Vodafone would reimburse me via credit on my account.



I was not given anywhere to send the receipt so I got back in touch, via live chat, and was informed there was no record of such a conversation. I was asked to call 191, which I did, and after being transferred from the first representative because their computer crashed, I explained my problem again (for the 4th time in total) and was put on hold.



Some minutes later I found myself talking to a confused lady who works for a company that Vodafone outsource their repairs to. She informed me that the promise of a repair refund was never an option; I was, in short, gravely misled by your online representative.



Now: I have redress under the Sale of Goods Act 1979. The device was not sold fit for its purpose as not only has it failed a long way short of the 2 year term of the contract, it has done so in a manner that no reasonable person would expect and this was clearly not the result of normal wear and tear. Let me reiterate, it fails with battery power STILL REMAINING...it does not simply run down more quickly.



Additionally, I have been lied to and transferred without warning and generally given the complete run-around.



Here is what I think needs to happen:



You will advise me that I may go into a Vodafone retail outlet of my choice and obtain a replacement iPhone at no extra charge to myself. Paying for a repair is not an option; sending the phone away for repair is not an option. Being told that I have misinterpreted the Sale of Goods Act is not an option.

Assuming the phone was supplied by Vodafone, the Sale of Goods Act doesn't apply at all.

 

The relevant statute is the Sale of Goods and Services Act. I believe the provision are very similar though.

 

The battery in a phone is considered to be like a consumable and the normal situation is that the network won't pay for a new battery after a year of use. So the chances of getting your money back is very remote I'd say.

Just to inform you this is a discussion forum only with no account access and Vodafone do not reply here in connection to these types of issues. 

 

Im sure your aware how long  put on their iPhones regarding warranty which is 12 months. Of course you can look at the Uk guidelines from http://www.apple.com/uk/legal/statutory-warranty/ and I wish you all the best with that avenue. 

 

May I ask have you tried any of the troubleshooting tips such as calibration of your battery and or a restore. Have  run any diagnostics on the iPhone via a https://www.apple.com/uk/retail/geniusbar/ appointment. Even tho it's out of the 12 months they maybe able to assist. 

 

Does the internal Battery settings show any rogue app or what's using the battery. Apps such as Facebook is a well known one. 

 

May I add : Other options such as household insurance and or some Bank Accounts offer cover. T&C and excess fees would apply. Also  offer an out of warranty service at a fee.
