Vodafone issuing "3" network phones

Went for an upgrade in Dec14, my phone came with a Vodafone packaging than a Sony packaging for my Sony Z3, became suspicious ( no Sony seal or packaging ) and called on the 16th day after I returned from my holiday. Vodafone rejected my claim stating that i didn't call within the 14 days. With all my attempts failed to resolve this issue, I emailed , called and spoke to many people, but no use. I started using the phone last Friday and found one speaker sound was crackling and sent for repair and received the phone Thursday stating that they have replaced the faulty speaker, but still had the same issue and sent again for repair. This clearly indicates that I never received a brand new phone, could be a customer return... what an experience with Vodafone. Received a refurbished handset yesterday when I went to collect from repair (my original handset cant be repaired), initially I was told i am getting a "Brand New" phone by the store agent , but when I asked the manager to confirm, she accepted its a refurbished handset, with few scratch marks and dust in the speaker and sim slot. Came home and inserted the sim and found the phone has pre- installed "3" network apps, no idea how can this happen , may be Vodafone is using the same repair agent as 3 network... again I had to send the phone back for repairs to get a Vodafone handset.. so far no one called me and given any reason why I was not sent a brand new handset in the first place, I will be sending all the details to Ombudsman soon, if i dont hear from Vodafone......
