As it's only for new or upgrading customers, who read the T&Cs before committing, then no, you can't get out of your contract because of it.

Hey @Rutledge, I think there's been a little confusion regarding these charges. You will only receive these roaming charges if you've taken out a new connection or upgraded after 11 August. These charges will be confirmed in the Ts&Cs of any contract taken out after this time.
