I won a bid on ebay but galaxy s6 is on contract phone locked to Vodafone.

bid for galaxy s6 unwated upgrade. 

he said he won't block the phone.

but if he stop's paying for the contract sim will the phone get blocked?

how will i know if the phone is on insurance ?

I am always wary of people who build up a Feedback by seling cheapish items.  It adds to the figures but does not really give me confidence.

 

Was there a 14 day returrns policy?

no return 

but i havn't paid him yet

i told him i will pay him today

I would not pay and explain by email to Ebay that the seller is auctioning an item that he does not own as it still belongs to Vodafone. You'll be ok with that.

If you've won the bid then your locked in to pay him unless you ask the seller if they'll release you from the commitment. 

 

If you withdraw without agreement they could raise a dispute against you.

I see that @63johnw has given you the ideal way to recind the contract.

 

Just make sure you keep a copy of you emails and messages in case of a problem with the seller.

 

You can tell him you have sought advice from Vodafone and as as the item is not his to sell as it is still Vodafone's property you are not able to go ahead.

As the seller doesn't have legal title there cannot be a dispute. The sale is illegal.

One point to ponder ....

 

 

Do we actually know how long the seller has had the phone ?

 

We are seeing the phrase "unwanted upgrade" and attaching an assumption they have not had it for long.

Unfortunately that does not confirm how long they've had possession of the phone.
