Sure Signal has let the smoke out

Hello!

 

I have an issue with my sure signal 3. It operated fine for ages (had previous sure signal 2) and I don't think there's any issues with my network or broadband, at least that's not what's causing my sure signal issues right now.

 

How can I be so confident that its not my local network? I'm pretty sure it was the smoke and flames that caused the issue.

 

Sure signal is dead, smoke and flames (I was sitting next to it when it when off), some interesting internal damage (I figured what's the harm in taking it apart now, right?).

Now, yes I know there's a 2 year warranty but I will at this point quote the sale of good act:

 

"Under the Sale of Goods Act 1979, goods should be of a satisfactory quality, fit for purpose and as described. My rights have been breached because the item you sold me is faulty. I would like a replacement."

 

So, unless Vodafone wish to take the postion that the product sold isn't intended to last very long I would appreciate if someone would contact me to arrange a replacement as soon as possible.

Hi there

 

And taking it apart could just have voided your warranty.  Under most warranties, if you tamper with the device, as you have done, it is void.  You now will have to prove to Vodafone that the internal damage hasn't been caused by your tampering.

 

No matter how tempting it is to find out what has gone wrong, never open up a device.  The Sale of Goods act doesn't give you any rights if you have tampered with the device.

Fortunatley your comment is nonsense, and the warranty itself is already void due to the age of the device. The buden of proof that I had in fact caused the damage in such a circumsace would be with Vodafone.

My comment isn't nonsense as I had no way of know exactly how old the device was.  If it was still under warranty, it would be void as I said, because you had tampered with it.

Again, you are wrong. Once the item is more than 6 months old, the onus is then on the user to prove that there was a fault at time of purchase. As it is out of warranty, ie more than 24 months old, it is definitely up to you to prove that the fault was there. You'd also now have to prove that your tampering didn't cause the issue!

Think about it logically - I open up my phone and in doing so damage the device. Can I take my device back to the retailer and ask them to repair it? Absolutely not.  Why? Because by opening the device, I have caused the damage.  The Sale of Goods Act doesn't cover any damage I inflict on the device and no retailer or manufacturer can be forced to repair a device you have tampered with (at least not free of charge)

I am quite aware of that but it doesn't change the fact that the OP tampered with the device.  By doing so, they have caused themselves more of a headache.

What planet are you on?

 

Where does it state that opening a Sure Signal voids the warranty? (this isn't a hard drive with "warranty void" sticker all over it you know).

 

 

As for your phone comment, again it's nonsense. Manufacturs/Suppliers cannot demand that you use their services to inspect, repair, or maintain a product even within its warranty period (the whole basis of the 2003 decision that car manufacturers can't force you to use a main dealer).

 

I don't think you should be giving out advice here, your qualifications are clearly lacking and your credentials (and affinity to Vodafone) are severley in doubt at this point.

 

I assume you're a Vodafone employee, or at least officially representing Vodafone in some way? A 6 year member of this forum, 22k+ posts (assume 250 working days a year) that's ~15 posts per day. Time for lunch, breaks etc, thats 1 post ever 20 minutes for 6 years.

 

Please state for the record your relationshop with Vodafone and if your advice should be taken as the official legal position of Vodafone in this matter?

Mine has just blown up!

Just to finish off this post I'll give the details of what happened, as everyone I know with a SS3 has had it blow up in the last month (3!).

 

Vodafone customer service advised that I visit a store to get a replacemnet as soon as possible. That didn't go 100% according to plan (details irrelevant) but eventually Vodafone agreed to provide a refurbished/nearly new replacement free of charge. Unfortunatley that "nearly new" replacement turned out to be totally defective (no lights at all). One more call to Vodafone and I got a new SS3 dispatched priority, no charge, all installed and working fine.

 

These were the objections I had in the store that proved to be false, I wouldn't let it stop you pushing for a FOC replacement:

 

 - Sales Of Goods Act "doesn't apply to accessories". False. Vodafone customer service don't consider the SS to be an accessory (i.e. it's not a consumable like a screen cover or case).

 

 - Sales Of Goods Act DOES apply for up to 6 years. Unless Vodafone are prepared to make a statement that the device isn't designed to last more than 2 (whaterver) years you can still argue this point.

 

So, I did get my SS3 replaced FOC, but it was a bit of a pain and took over 2 weeks to resolve. Would I go through it again to save £70? Probably not.
